A workplace is defined as “any place visited by the employee arising out of or during the course of employment, including transportation provided by the employer for undertaking such a journey.” As per this definition, a workplace covers both the organized and un-organized sectors. It also includes all workplaces whether owned by Srilankan or foreign company having a place of work in Sri lanka. Sexual harassment is bullying or coercion of a sexual nature and the unwelcome or inappropriate promise of rewards in exchange for sexual favors. Sexual harassment includes a range of actions from mild transgressions to sexual abuse or assault. A harasser may be the victim's supervisor, a supervisor in another area, a co-worker, or a client or customer. Harassers or victims may be of any gender. Victims of sexual harassment typically feel humiliated as a result of the oppressive experience of being harassed in the workplace. A normal response is for victims to feel depressed, angry and powerless. Under the emotional strain of sexual harassment, it is difficult to assess the situation and to respond appropriately and assertively. It evolves from discriminatory grounds, and has an effect of nullifying or impairing a person from benefiting their rights. When these behaviors become repetitive it is defined as bullying. Sexual harassment refers to persistent and unwanted sexual advances even after gently refusing, typically in the workplace, where the consequences are potentially very disadvantageous to the victim if there is a power imbalance between the perpetuator.
